In the normal course of our business, Peridot Global Holdings Limited and its subsidiaries and affiliates  (collectively “GSCF” or “we”) may collect, use, store, and/or share your personal data. This Privacy Notice (“Notice”) is intended to provide you with an explanation of the type of personal data we may process, how we may process it, and the rights that may be available to you under law.

THE SCOPE OF THIS NOTICE

This Notice applies to GSCF’s websites or social media pages (collectively “Sites”). This Notice also applies to our direct marketing activities as well as all customer interactions, including but not limited to the establishment of a customer relationship with GSCF. This Notice applies only where GSCF may collect, use, store, share, or otherwise process personal data.

– “personal data” means any information relating to an identified or identifiable natural person and any information defined as “personal data”, “personal information” or similar in the Applicable Data Protection Law; 

– “Applicable Data Protection Law” means European Union General Data Protection Regulation, United Kingdom General Data Protection Regulation, Swiss Federal Act on Data Protection, California Consumer Privacy Act or such other law, act or regulation applicable to processing of your personal data by GSCF, as the case may be;

– “including” shall not be exclusive, shall not limit the generality of the words preceding it, and shall mean “including, without limitation”.

THE PESONAL DATA WE MAY COLLECT AND WHEN WE COLLECT IT 

We may collect and process your personal data when:

    • Information that you provide by filling in forms on our websites. This includes information provided when subscribing to our services (for example to receive information from us) requesting further information;

    • We need to have sufficient information to provide you those services, as well as fulfill legal requirements associated with such services or products (e.g., payment and financial details, “Know Your Customer” requirements, etc.).

HOW WE MAY COLLECT YOUR PERSONAL DATA

We may collect your personal data:

  • From third parties (e.g., third party fraud monitoring, credit services or Know Your Customer diligence services).

WHY WE COLLECT YOUR PERSONAL DATA AND HOW WE PROCESS IT

We process your personal data to deliver our products and services and otherwise perform various contracts made between you and GSCF, to inform you about GSCF’s products and services, to invite you to participate in our events, to onboard you as a customer, to validate your identity, to perform required “Know Your Customer” and other related fraud and anti-money laundering preventative measures. 

We may also process your personal data to comply with various legal requirements, including reporting and retention requirements, and to otherwise communicate with you in accordance with applicable law.

Additionally, we may use your personal data for the following purposes:

  • To coordinate the administration of client relationships and client interactions;
  • To ensure that content from our Sites is presented in the most effective manner for you and for your computer;
  • To provide you with the information, products, and services that you request from us or which we feel may interest you;
  • To allow you to participate in interactive features of our Sites and otherwise enhance user experience;
  • To notify you about changes to what we do;
  • To improve the products and services we offer;
  • To protect the integrity of our website, our services, and our reputation;

WITH WHOM WE SHARE YOUR PERSONAL DATA

No personal data will be sold, traded or rented to others for their own purposes. However, we may disclose your personal data, for the purposes described above in this Notice, with the following entities:

  • With our vendors: We may share your personal data with vendors that provide services to us or on our behalf, such as enterprise software providers, customer service, audit and accounting firms, law firms, security vendors, marketing and events services, travel services, fraud and anti-money laundering prevention firms, and physical or electronic information storage services. We authorize vendors to process personal data only as necessary to perform services or comply with legal requirements. We require our vendors to contractually commit to protect the security and confidentiality of the personal data they process on our behalf;
  • With our affiliates: We share personal data with our affiliates to effectively deliver our products and services as well as for internal administrative purposes;
  • With our unaffiliated strategic partners: We may share personal data with other select unaffiliated entities to carry out joint development, marketing, delivery and/or management of our products and/or services;
  • With our advertising partners:We share personal data with our advertising agencies in support of our marketing campaigns. We authorize these vendors to use or disclose personal data only as necessary to perform services or comply with legal requirements;
  • With governmental authorities and regulatory agencies (as necessary): We share information with law enforcement agencies, courts, other government authorities or other entities, where we believe it is necessary: (i) to comply with a legal or regulatory obligation; (ii) to protect the rights, safety, and property of GSCF, you, or others; and (iii) to respond to requests from courts, law enforcement agencies, regulatory agencies, and other public and government authorities;
  • With third parties during a merger, acquisition, joint venture, or divestiture: We may share personal data in connection with the consideration, negotiation, or completion of a corporate transaction, such as a merger or acquisition or a sale or transfer of all or a portion of our assets or business, including during any due diligence process.

WHERE IS YOUR PERSONAL DATA?

Your personal data may be transferred to different countries for the purposes identified above, both to our affiliates and to third parties listed above. Transfers of your personal data to the said recipients may be based on an adequacy decision, the standard contractual clauses approved by the European Commission or any other applicable lawful transfer mechanism.

FOR HOW LONG DO WE STORE YOUR PERSONAL DATA?

Your personal data will be kept for the time necessary to fulfil the relevant purpose of its collection and processing, as stated above, as well as for any additional and relevant periods set out in GSCF’s policies, applicable legislation, including any statutory periods applicable to potential claims related to our business activity.

RIGHTS OF INDIVIDUALS LOCATED IN THE EUROPEAN ECONOMIC AREA, SWITZERLAND OR UNITED KINGDOM

As a data subject, you are entitled to exercise the following rights, at any time: 

  • Access your personal data being processed by GSCF (and / or obtain a copy of those personal data), as well as information on the processing of your personal data;
    • Correct or update your personal data being processed by GSCF, where it may be inaccurate or incomplete;
    • Request the deletion of your personal data being processed by GSCF, where you feel that the processing is unnecessary or otherwise unlawful;
    • Request the restriction of the processing of your personal data, where you feel that the personal data processed is inaccurate, or that the processing is unnecessary or unlawful, as well as where you have objected to the processing;
    • Exercise your right to data portability – the right to obtain a copy of the personal data you provided to GSCF in a structured, commonly used and machine-readable format, as well as to request the transmission of those personal data to another data controller;
    • Object to the processing of your personal data, based on relevant grounds related to your particular situation, which you believe must prevent GSCF from processing your personal data for a given purpose.

RIGHTS OF CALIFORNIA RESIDENTS

Residents of the State of California in the United States of America have the right to request information from GSCF regarding other companies to whom GSCF has disclosed certain categories of information during the preceding year for the other companies’ direct marketing purposes. 

The California Consumer Privacy Act (“CCPA”) provides California residents with rights to receive certain disclosures regarding the collection, use, and sharing of personal data, as well as rights to know/access, delete, and limit sharing of personal data. . Certain information we collect may be exempt from the CCPA because it is considered public information (i.e., it is made available by a government entity) or covered by a specific federal privacy law, such as the Gramm–Leach–Bliley Act, the Health Insurance Portability and Accountability Act, or the Fair Credit Reporting Act. To the extent that we collect personal data that is subject to the CCPA, that information, our practices, and your rights are described below:

  • You have the right to request access to personal data collected about you and information regarding the source of that information, the purposes for which we collect it, and the third parties and service providers with whom we share it. To protect our customers’ personal data, we are required to verify your identity before we can act on your request.
  • You have the right to request in certain circumstances that we delete any personal data that we have collected directly from you. To protect our customers’ personal data, we are required to verify your identity before we can act on your request. We may have a reason under the law why we do not have to comply with your request, or why we may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response.
  • GSCF does not sell nor receive any form of remuneration for the transmission of your personal data. Where GSCF does disclose your personal data to third parties, the disclosure is made for specified purposes directly related to the delivery of a needed service. Our third‐party partners are not permitted to use your personal data in any manner other than what is necessary to fulfill the services requested.
